That is why they can start working with heavy construction equipment at 6:30 in the morning, before the Dept of Environmental Protection has any opportunity to react. You may imagine how backed up the DEP is these days, with frantic construction taking place all over the borough. As it is, OCA wants those trucks loaded early because each one has to make two round trips to Delaware each day. There are 20 trucks. So from a practical point of view, while this project (which is no longer committed to some artistic cause and no longer connected to its supposed educational purpose), it is in the interest of profit this ought to be done, regardless of various rules and social conventions. Yes, Sam, in NYC it is possible to operate a business unlawfully and get away with it. From a moral point of view...well, there isn't one here, is there? It's development, and all development is good (it's Ayn Randian!), creating jobs and various trickle-down effects.
